Summary

Thurston County requires cyclists on a roadway to keep right and ride no more than two abreast, and mandates using an adjacent bicycle path instead of the roadway wherever one exists. Breaking these rules is a misdemeanor under TCC 12.61.580, and TCC 12.80.060 separately bars wheeled all-terrain vehicles from operating or parking in any designated bicycle lane.

These county ordinances apply to unincorporated areas of Thurston County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

12.61.600 - Riding on roadways and bicycle paths. (1) Every person operating a bicycle upon a roadway shall ride as near to the right side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction. (2) Persons riding bicycles upon a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles. (3) Wherever a usable path for bicycles has been provided adjacent to the roadway, bicycle riders shall use such path and shall not use the roadway. 12.61.580 - Effect of regulations—Penalty. (1) It is a misdemeanor for any person to do any act forbidden or fail to perform any act required in Sections 12.61.580 through 12.61.610. 12.80.060 - Prohibited activities. C. No person shall operate or park any WATV on any sidewalk, walkway, pedestrian trail, designated bicycle lane, or bridge where the operation of motor vehicles is prohibited.

Full Breakdown

600 sets three riding rules for bicyclists using county roadways. Riders must stay as near the right side of the roadway as practicable, using due care when passing a standing vehicle or one moving in the same direction. Bicyclists may not ride more than two abreast on a roadway, except on paths or portions of roadway set aside exclusively for bicycles. Where a usable bicycle path runs alongside a roadway, riders must use that path and are barred from the roadway itself. 610, that also covers proper seating, passenger limits, no clinging to other vehicles, carrying articles that block handlebar control, and required lamps and reflectors after dark.

610, and confirms the rules apply whenever a bicycle is ridden on a highway or on a path reserved exclusively for bicycles. 060(C), part of the county's wheeled all-terrain vehicle (WATV) chapter, prohibits operating or parking any WATV on a sidewalk, walkway, pedestrian trail, designated bicycle lane, or bridge closed to motor vehicles, protecting bike lanes from motorized incursion. 030 at a fine up to $300, up to 90 days in county jail, or both.

Violations & Fines

Riding two-plus abreast on a roadway outside a bike path, riding the roadway when a usable adjacent bike path exists, or otherwise violating Sections 12.61.580-12.61.610 is a misdemeanor under TCC 12.61.580. Sentencing follows the Title 12 general penalty in TCC 12.64.030: a fine of not more than $300, imprisonment in the county jail for not more than 90 days, or both, where no other punishment is specified. A WATV operated or parked in a designated bicycle lane violates TCC 12.80.060(C) and is enforced as a traffic infraction under TCC 12.80.090, chargeable under RCW 46.63, with any resulting property damage (to trees, shrubs, crops, or ornamental vegetation) recoverable as treble damages under RCW 46.09.490(2).

Frequently Asked Questions

Can I ride my bicycle on the road if there is a bike path next to it in Thurston County?
No. TCC 12.61.600(3) requires that wherever a usable bicycle path has been provided adjacent to a roadway, bicycle riders must use that path and may not use the roadway instead, so the path is mandatory, not optional, when one exists.
How many cyclists can ride side by side on a Thurston County road?
No more than two abreast on a roadway. TCC 12.61.600(2) allows riding more than two abreast only on paths or portions of the roadway set aside exclusively for bicycle use; anywhere else on shared roadway, two abreast is the limit.
What happens if someone parks an ATV in a bike lane in Thurston County?
TCC 12.80.060(C) bars operating or parking a wheeled all-terrain vehicle on any sidewalk, walkway, pedestrian trail, designated bicycle lane, or closed bridge. It is enforced as a traffic infraction under TCC 12.80.090, chargeable under RCW 46.63, plus treble damages for any vegetation harmed.
