In the City of Placentia, California, noise from a bar or nightclub is measured under Chapter 23.76 of the zoning title: commercial property is Noise Zone 2 at 65 dB(A) at any time, and music, speech, impact or simple tone noise cuts each limit by 5 dB(A). A violation is a misdemeanor, and every day counts as a separate offense.

(a) The following noise standards, unless otherwise specifically indicated, shall apply to all real property within a designated noise zone: Noise Standards Noise Zone Noise Level Time Period 1 55 dB(A) 7:00 a.m.—10:00 p.m. 50 dB(A) 10:00 p.m.—7:00 a.m. 2 65 dB(A) Anytime 3 70 dB(A) Anytime In the event the alleged offensive noise consists entirely of impact noise, simple tone noise, speech, music, or any combination thereof, each of the above noise levels shall be reduced by 5 dB(A). (b) It is unlawful for any person at any location within the incorporated area of the city to create any noise, or to allow the creation of any noise on property owned, leased, occupied, or otherwise controlled by such person, when the foregoing causes the noise level, when measured on any other residential, commercial, or industrial property, either incorporated or unincorporated to exceed: (1) The noise standards for a cumulative period of time more than thirty (30) minutes in any hour; or ... (5) The noise standard plus twenty (20) dB(A) for any period of time.

Full Breakdown

The Placentia Municipal Code has no chapter written only for bars. Section 23.04.010 defines a nightclub as any bar, cocktail lounge, discotheque or similar establishment that provides entertainment, including music, dancing or comedy, in conjunction with alcoholic beverage sales. The noise those businesses make is judged under Chapter 23.76, Noise Control, which divides the city into three zones (Section 23.76.040): Zone 1 is all residential property, Zone 2 all commercial property, and Zone 3 all industrial property.

Section 23.76.050 sets the exterior standards: Zone 1 is 55 dB(A) from 7:00 a.m. to 10:00 p.m. and 50 dB(A) from 10:00 p.m. to 7:00 a.m., Zone 2 is 65 dB(A) at any time, and Zone 3 is 70 dB(A) at any time. Because a nightclub's output is music and speech, the printed 5 dB(A) reduction applies to each level. The limit is tested where the sound lands. Under subsection (d), when the source and the affected property sit in different zones, the standard for the affected property controls, so a bar next to homes answers to the residential limits. Under Section 23.76.100, exterior readings are taken at any point on the affected property.

The time allowances run from 30 minutes in any hour at the standard, down to one minute at the standard plus 15 dB(A), and no time at all above the standard plus 20 dB(A). Section 10.32.030 separately bars any public address system, loudspeaker or sound amplifying device whose sound carries onto other property or a public street as a loud, unnecessary or unusual noise.

Entertainment also needs permission. Section 6.56.010 requires a chief of police permit to provide entertainment in a restaurant or other place serving food or refreshments and open to the public, and Section 6.56.070 lets the chief attach restrictions, time limits or conditions, with revocation if they are ignored. Section 6.52.190 requires a city permit for any public place that dispenses alcohol and offers entertainment or public dancing. Section 23.76.120 lets a noise source apply for a variance for a $75 fee.

Violations & Fines

Under Section 23.76.150, violating Chapter 23.76 is a misdemeanor, and each day the violation is committed or permitted to continue is a separate offense. Enforcement officers can arrest without a warrant for a misdemeanor committed in their presence under Section 23.76.110. A breach of entertainment permit conditions makes the permit revocable under Section 6.56.070.

Frequently Asked Questions

What noise limit applies to a bar in the City of Placentia?
Section 23.76.050 sets 65 dB(A) at any time for Noise Zone 2, which is all commercial property. When the noise is only music, speech, impact noise or simple tone noise, each limit is reduced by 5 dB(A). If the sound is measured on residential property, the residential standard for that property applies instead.
Does a nightclub in Placentia need an entertainment permit?
Section 6.56.010 requires a permit from the chief of police to provide entertainment in a coffee shop, restaurant or other place serving food or refreshments and open to the public. Section 6.52.190 separately requires a city permit for any public place dispensing alcohol where entertainment or public dancing is offered.
Can the police chief limit a venue's hours of entertainment?
Yes. Section 6.56.070 says the chief of police, in granting an entertainment permit, can place restrictions, time limits or conditions on how the permittee operates. The permit is revocable if the conditions are not followed, and the chief is charged with enforcing them. An applicant can appeal a decision to the city council within 72 hours.
Can a venue apply for relief from the noise standards?
Section 23.76.120 lets the owner or operator of a violating noise source apply for a variance, with a $75 fee and a separate application for each noise source. The noise variance board can set terms, including limits on noise levels and operating hours. An appeal to the city council is due within 15 calendar days of the board's decision.
Is a noise violation a crime in Placentia?
Yes. Section 23.76.150 makes any violation of the Noise Control chapter a misdemeanor, and each day the violation is committed or permitted to continue is a separate offense. Section 23.76.110 also authorizes the city's enforcement agent to make a warrantless arrest for a misdemeanor committed in the agent's presence.
