Full Breakdown
Sec. 46-130(2) of the Brevard County Code prohibits loading and unloading boxes, crates, containers, building materials, garbage cans, or similar objects during nighttime hours if doing so creates a noise disturbance across a residential real property boundary. Nighttime hours run 10:01 p.m. to 6:59 a.m. under Sec. 46-126. The rule applies only in unincorporated Brevard, cities like Cocoa, Titusville, Melbourne, and Palm Bay enforce their own codes. Garbage, recyclable, and yard-waste collection is separately exempted between 5:00 a.m. and 9:00 p.m. under Sec. 46-129(20), so trash trucks on that schedule are not covered by this delivery-noise ban.
Violations & Fines
Enforcement officers issue a written warning first under Sec. 46-134; continued violations go to code enforcement before the special magistrate, with fines up to $500 or 60 days in jail under Sec. 1-7, each day a separate offense.
