Section 5.04.130(A), part of Chapter 5.04's Noise Abatement and Control provisions adopted by Ordinance 558 in 2019, makes it unlawful to engage in loading, unloading, opening, idling of trucks, closing or other handling of boxes, crates, containers, building materials, garbage cans, dumpsters or similar objects between 10:00 p.m. and 7:00 a.m. if doing so causes a noise disturbance within or adjacent to a residential district. Subsection (B) extends liability to anyone who causes, permits or facilitates a violation of subsection (A), so a business owner cannot avoid responsibility by pointing to a third-party delivery driver who idled a truck outside the curfew.

The section works alongside Section 5.04.050, which separately confines refuse-compacting and collection vehicles to the hours between 7:00 a.m. and 10:00 p.m. near residential zones, so a waste hauler faces two overlapping curfews. Because the loading-dock rule turns on whether the activity causes a noise disturbance, defined in Section 5.04.020 as any sound causing discomfort or annoyance to persons of normal sensitivity residing in the area, an inspector weighs the actual disruption rather than a fixed decibel reading. The Noise Control Officer, the Director of Community Services under Section 5.04.020, has primary enforcement authority and can draw on Sheriff's Santee Station deputies under Section 5.04.180 for after-hours calls near warehouses and retail centers along Mission Gorge Road and Cuyamaca Street.
