Dallas Development Code Section 51A-6.102 establishes noise limits for mechanical equipment including HVAC systems. Equipment noise may not exceed the established zoning district sound level limits or the background level by more than 5 dB(A), whichever is greater. Chapter 30 also addresses HVAC noise as a potential nuisance.
Dallas regulates HVAC and mechanical equipment noise through two code sections. Section 51A-6.102 of the Dallas Development Code (Noise Regulations under Environmental Performance Standards) prohibits conducting a use that creates noise exceeding the levels established for the applicable zoning district boundary or exceeding the background level by 5 dB(A), whichever is greater. This applies to all mechanical equipment including air conditioners, heat pumps, pool pumps, and generators. Separately, Chapter 30 of the Code of Ordinances addresses noise as a general nuisance, making it unlawful to make unreasonably loud, disturbing, and unnecessary noise. HVAC equipment that disturbs neighbors, particularly during nighttime hours, may be cited under either provision. Code Compliance handles commercial property complaints while Dallas Police handle residential noise issues.
Violations of Section 51A-6.102 may result in zoning enforcement action including fines. Chapter 30 noise violations are Class C misdemeanors with fines up to $2,000 for commercial violations. Repeat offenders face escalating penalties. Equipment may be required to be modified, relocated, or fitted with sound barriers.
