Chapter 9.24 defines a "fixed sound source" in Section 9.24.020 to include "residential, agricultural, industrial and commercial machinery and equipment, pumps, fans, compressors, air conditioners and refrigeration equipment," the category that would otherwise be measured against the sound level standards in Section 9.24.100. Section 9.24.030(A) carves residential HVAC out of that enforcement: "sound sources typically associated with residential uses (e.g., children at play, air conditioning and similar equipment, but not including barking dogs)" are exempt from the chapter altogether. That means a code enforcement officer, defined in Section 9.24.020 as "the city manager or designee," cannot cite a homeowner for a running central air unit or window unit under the decibel tables that apply to industrial or amplified sound.

The carve-out is narrow: it covers equipment typically associated with residential uses, so a commercial rooftop condenser or an industrial refrigeration compressor on an industrial-zoned parcel remains subject to the sound level standards and, where it borders a sensitive receptor, to Section 9.24.120's industrial limits. Even an exempt residential AC unit is not entirely beyond reach: Section 9.24.150 separately makes it unlawful to "wilfully make or continue... any loud, unnecessary, excessive or offensive noise... which unreasonably disturbs the peace and quiet of any sensitive receptor," a catch-all nuisance standard the enforcement officer can apply to a negligently maintained or malfunctioning unit regardless of the equipment exemption.
