Olathe, KS Noise Ordinances: Aircraft Noise (2026)

Olathe Municipal Code § 6.18.040(H) is the part of the city's Noise Control Ordinance that addresses airport and aircraft operations serving Olathe and greater Johnson County. It contains paragraphs (1) and (2), and each does a different job.

Paragraph (1) gives Olathe a consulting role. The director of Development Services shall consult with the Johnson County Airport Commission to recommend changes in airport operations to minimize any noise disturbance. The wording is specific: the director consults and recommends. The subject is airport operations, the counterpart is the Johnson County Airport Commission, and the stated goal is to minimize noise disturbance. Paragraph (1) as quoted describes recommendations, not orders from the city.

Paragraph (2) limits the reach of the Olathe section itself. Nothing in § 6.18.040 shall be construed to prohibit, restrict, penalize, enjoin, or in any manner regulate the movement of aircraft conducted in accordance with, or pursuant to, applicable federal laws or regulations. That string of verbs closes off the usual tools of a noise ordinance. Olathe's section cannot be read to ban the flight, limit it, fine it, or support a court order against it, and the phrase "in any manner regulate" covers anything the list leaves out.

The exemption in (2) carries a condition. It protects aircraft movement that is "in all respects" conducted under applicable federal laws or regulations, and it is written about the movement of aircraft.

For an Olathe resident, the result is that helicopter and fixed-wing traffic answers to the FAA, not the city. A complaint about a federally compliant flight cannot lead to a city penalty under § 6.18.040, because paragraph (2) bars the section from penalizing that movement.
