Subsection (d)(2)m separately bars using any bell, drum, loud speaker, whistle or other device to attract attention to a performance, show or sale of merchandise by creating noise, except for ice cream vendors between the hours of 7:00 a.m. and dusk.
Where a decibel test does apply, § 34-191(i)(2) excepts a restaurant, as defined by Alcoholic Beverage Code § 1.04, whose amplified music or amplified speech stops by 10:00 p.m. Sunday through Thursday and 11:00 p.m. Friday and Saturday and stays at or under 70 dBA or 75 dBC at the establishment's property perimeter. That exception does not apply to a food service establishment within 300 feet of a residence occupied before any food service establishment was located on the property.

Under § 34-191(h), a violation is an offense punishable by a fine of not more than $2,000.00 for each event or violation, and each day a violation occurs or continues is a separate offense. The violation is also a nuisance, and prosecution does not limit the city's right to abate it with injunctive or other civil relief.
