Nevada County has no stand-alone amplified-sound ordinance for unincorporated areas, but noise containing music or speech can trigger a stricter, lower noise standard under General Plan Policy 9.1.2.e and County Code Sec. 12.04.070. Under the Nevada County General Plan Noise Element (Policy 9.1.2.e) and Nevada County Code Sec. 12.04.070.D.7, the county reserves the right to impose a noise standard more restrictive than the Exterior Noise Limits table when the noise has unique characteristics, expressly including noise that 'contains music or speech,' is impulsive in nature, is a pure tone, or is of long duration (the current code defines long duration as a cumulative period of more than 30 minutes in any hour). That means amplified music reaching neighboring noise-sensitive properties is evaluated more strictly than ordinary mechanical noise and remains subject to the base limits of 55 dBA Leq daytime and 40-45 dBA Leq nighttime in rural and residential districts. Independent of the land use standards, the Nevada County Sheriff can enforce California Penal Code Sec. 415(2) against any person who maliciously and willfully disturbs another by loud and unreasonable noise, including loud parties and amplified sound systems.
County noise standards are enforced through compliance inspections and complaints; conditional uses such as event venues can face permit revocation for noncompliance. A Penal Code Sec. 415(2) conviction carries up to 90 days in county jail, a fine of up to $400, or both.
