Amplified music rules in Napa, CA β also called sound permit, PA system, or live music ordinances β set decibel limits, time-of-day restrictions, and when permits are required.
NMC 8.08.010 makes it unlawful to operate any loudspeaker, public address system, or sound amplification system audible outside a building unless one of five exceptions applies. As of recent practice, the Napa Police Department no longer issues amplified-noise permits - the City Manager handles 8.08.010 permits, residential events fall under NMC 9.50, and special-event amplification goes through Parks & Recreation.
NMC 8.08.010 sets the baseline: any loudspeaker, public address system, or amplification system that can be heard outside a building is unlawful, with five exceptions. (A) automobile-mounted amplification between 9:00 a.m. and 9:00 p.m. requires a City Manager permit; (B) any non-automobile use at any time of day or night requires City Manager approval; (C) amplification used with a musical instrument fewer than three days in a one-year period requires City Manager approval; (D) amplification used with a permitted parade or filming operation is exempt; and (E) amplification used in connection with a Title 17 use permit is exempt. The Napa Police Department has stopped issuing amplified-noise permits and now refers residents to NMC 9.50 (Loud and Unruly Gatherings), businesses to the Planning Division, and special-event organizers to Parks & Recreation. Park-based amplified sound is also governed by NMC Chapter 12.40 (Sound Amplifying Equipment in City Parks). Content-based regulation is constrained by Reed v. Town of Gilbert, so Napa applies 8.08.010 on a content-neutral basis - the standard is whether the sound is audible outside a building, not the message content.
An NMC 8.08.010 violation is enforceable through the City's general code-enforcement provisions; permits issued under the chapter are revocable by Council under NMC 8.08.050 if used in an illegal, disorderly, or improper manner. California Penal Code 415(2) (loud and unreasonable noise) is available to Napa Police for active disturbances and is a wobbler infraction or misdemeanor (up to 90 days, $400).
