Amplified music rules in Napa County, CA — also called sound permit, PA system, or live music ordinances — set decibel limits, time-of-day restrictions, and when permits are required.
Section 8.16.080 of the Napa County Code prohibits loudspeakers, radios, televisions, musical instruments and similar devices from being operated in a manner that creates a noise disturbance, except under a variance issued by the Noise Control Officer.
Chapter 8.16 of the Napa County Code prohibits any loud, unnecessary or unusual noise that disturbs the peace and quiet of any neighborhood or causes discomfort or annoyance to any reasonable person of normal sensitiveness. Section 8.16.080 specifically calls out loudspeakers, loudspeaker systems and similar amplification devices, as well as radios, televisions, phonographs, drums and musical instruments, and bars their operation in any manner that creates a noise disturbance across a real-property line or that exceeds the exterior noise limits in Section 8.16.070. Because Section 8.16.070 reduces the standard exterior limit by 5 dB whenever the offending sound contains music or speech, amplified music is effectively held to a stricter limit than general noise. Variances may be issued by the Noise Control Officer for special events. State law (Cal. Penal Code section 415) separately makes maliciously and willfully disturbing another person by loud and unreasonable noise a misdemeanor.
Operating amplified sound in violation of Section 8.16.080 is enforced as a Napa County Code violation; the Sheriff may also cite under Penal Code section 415 (disturbing the peace) when loud and unreasonable noise willfully disturbs another person.
