(A) No person shall harbor or keep any animal which by loud or frequent or habitual barking, howling or yelping, causes annoyance or disturbance to other person or persons living or having the right to be in the vicinity so as to hear said barking, howling or yelping. 04(A) makes it unlawful for any person to harbor or keep an animal that, by loud or frequent or habitual barking, howling or yelping, causes annoyance or disturbance to another person living in or having the right to be in the vicinity where the noise can be heard. The section builds in one defense: the owner can show the dog was a hunting dog engaged in legal hunting or hunting-related activity. 04(B) rounds out the nuisance standard with a broader list of conduct an owner may not knowingly or intentionally allow, including molesting passers-by or passing vehicles, attacking people or other animals, damaging property, being repeatedly at large, creating unsanitary conditions, making noise in an excessive, continuous or untimely manner, becoming a source of insect or rodent infestation, or otherwise disturbing the peace, comfort or health of people nearby.
04(C) separately requires an owner to immediately clean up after an animal that defecates on property it does not own, lease, rent or control, unless the property owner allows it. 04(D) bars intentionally feeding, watering or sheltering any domesticated or wild animal in a way that creates a nuisance, unsanitary conditions, infestation, or disturbance. The section was adopted by Ord. O-9-95 on May 17, 1995, and amended by Ord. O-09-18 on August 15, 2018.

Violations of § 90.04 are punished under § 90.99(B)(1) as a Class B misdemeanor on a first offense, carrying a fine of up to $250, up to 90 days in county jail, or both, with each animal involved counted as a separate violation. A second or subsequent offense is a Class A misdemeanor under § 90.99(B)(2), punishable by up to $500 and up to 365 days in jail.
