Cheektowaga, NY Noise Ordinances: Barking Dogs (2026)

Section 58-6 of the Town Code makes it unlawful for any person, firm or corporation to keep, or allow to be kept, on premises it owns, any dog whose frequent barking, howling, whining or other noise unreasonably disturbs the comfort or repose of any person. The standard is disturbance-based rather than decibel-based: there is no numeric limit or time-of-day carve-out in the text, so enforcement turns on whether the noise is frequent and unreasonably disturbs someone's comfort or repose, which the chapter's purpose clause in Section 58-1 lists as one of the article's four stated goals alongside licensing, population control and protecting people, property and other animals from dog attacks.

Because Article I applies only to the Town of Cheektowaga outside the Villages of Depew and Sloan, a barking complaint inside either village falls under that village's own code, not this section. The provision was carried forward when Article I was amended in its entirety on December 6, 2010, effective January 1, 2011, replacing the original 1985 town code chapter. Enforcement of Section 58-6 runs through the same peace officer/Agriculture and Markets structure used for leash violations under Section 58-3, since both sit in the same article and share its penalty section.
