Barking dog rules in San Luis Obispo County, CA — also called nuisance dog, dog noise, or excessive barking ordinances — define when a barking dog becomes a code violation and how complaints are handled.
Under San Luis Obispo County Code Section 9.04.080, a dog, cat or household pet is declared a public nuisance when three or more persons living in separate dwelling units in the neighborhood affirm in writing that the animal is a habitual nuisance due to frequent, persistent or long-continued howling, barking or other noise.
Section 9.04.080 of Title 9 (Animals), Chapter 9.04 (General Provisions) provides the abatement procedure. Three or more residents of separate dwelling units must affirm the nuisance in writing. The Animal Services Division (Health Agency) then investigates and, if it confirms the public nuisance, serves written notice on the owner or custodian directing abatement or impoundment. If the original petitioners later affirm in writing that the nuisance was not successfully abated, the Division presents the investigation results to the officer responsible for criminal prosecution in the jurisdiction. Nuisance Animal investigations are handled by SLO County Animal Services ((805) 781-4400). Section 9.04.080 thus does not require a specific decibel reading; the standard is whether the noise is frequent, persistent or long-continued and verified by three neighbors.
Failure to abate after notice may result in impoundment of the animal or referral to the prosecuting attorney for misdemeanor charges. The exterior noise standards of Section 23.06.044 may also be cited if the barking is recorded above 50 dBA Leq daytime or 45 dBA nighttime at the receiving property line.
