Animal control or police officers who find a dog doing this must first warn the owner or the person in charge of the property to get it under control. If the owner refuses to cooperate, cannot stop the dog, or cannot be located, the officer takes the dog into possession under the Chapter 5 impoundment rules (§ 5-400). Three or more violations of this section (or § 5-530, dogs running at large) within twelve months is separately classified as a nuisance under § 5-533, which lets the general district court order the animal confined, removed from the city, or otherwise abated.
