Harlingen, TX Noise Ordinances: Construction Hours (2026)

Harlingen lists this rule among the acts its noise code treats as per se violations. Section 34-114(e)(5) names the kinds of work it covers. The first is the construction, demolition, alteration or repair of any building. Because the wording is any building, the rule reaches a house under repair in a Harlingen neighborhood as well as a commercial project. The second is the excavation of streets and highways.

The section works by naming the allowed window and treating the work as a violation at any other time. On weekdays the window opens at 7:00 a.m. and closes at 8:00 p.m. On weekends it opens later, at 10:00 a.m., and closes at the same 8:00 p.m. A crew that starts at 7:00 a.m. on a Saturday is outside the window even though the same start is allowed on a weekday. Evening work must stop at 8:00 p.m. on every day of the week.

The provision carries its own emergency exception: in case of emergency, construction or repair noises are exempt. Separately, the city manager may authorize work to continue outside the normal hours if public health and safety won't be impaired and delay would cause loss or inconvenience.

A parallel exemption in § 34-114(f)(5) covers properly muffled construction equipment run on residential premises within those same hours, so a Harlingen homeowner using such equipment inside the window is not in violation.
