In unincorporated Calaveras County, construction noise is exempt from the noise ordinance only if it stays within permitted hours. Section 9.02.060 limits construction in or adjacent to residential areas to daytime hours between 7 a.m. and 6 p.m., unless a discretionary land-use permit sets different conditions.
Calaveras County Code Section 9.02.060 lists the activities exempt from the Noise Control ordinance, and construction is one of them, but the exemption is conditional. Sound from construction activity is exempt provided that all construction in or adjacent to residential areas is limited to the daytime hours between 7:00 a.m. and 6:00 p.m., unless otherwise subject to conditions in a valid discretionary land-use permit (such as a use permit) that addresses construction noise for the project. 'Construction' is defined broadly in Section 9.02.020 to include site preparation, assembly, erection, repair, enlargement, alteration, conversion, or demolition of any building, structure, or land. Work performed outside the 7 a.m. to 6 p.m. window in or near residential areas loses the exemption and is then judged against the general standard in Section 9.02.030, which caps sound at background plus 10 dBA in the day and plus 5 dBA at night. The ordinance applies in the unincorporated county only; the City of Angels Camp has its own code. Note that emergency work, such as repairing water, gas, electric, sewer, or public-transportation facilities or removing fallen trees, is separately exempt under Section 9.02.060.
Construction outside permitted hours loses its exemption and can be cited as a noise disturbance under Chapter 9.02. A first violation is an infraction; repeat violations within 12 months become misdemeanors, and all are abatable public nuisances.
