Overland Park, KS Noise Ordinances: Construction Hours (2026)

Overland Park Municipal Code Section 7.08.002.C makes it a Noise Disturbance for a sound resulting from erecting, constructing, excavating, demolishing, altering or repairing any structure, or from operating or permitting the operation of tools or equipment used in construction, drilling or demolition work, in a manner that causes a sound Plainly Audible across any property boundary line between 9:00 p.m. and 7:00 a.m. Between 7:00 a.m. and 9:00 p.m., the ordinance expressly exempts this activity from the time, area and dB(A) limits set in subsection A, meaning contractors face no numeric decibel cap during the permitted daytime window.

"Plainly Audible" is defined in Section 7.08.001 as capable of being heard without needing to make out words or melody, so the overnight bar is easy to enforce: an officer needs only confirm the sound crosses the property line, not measure decibels. This is one of five time-restricted activities under Section 7.08.002 (alongside vehicle repair, amplified sound, lawn equipment and power tools), each carved out of the numeric dB(A) table during its permitted hours. Ordinance history traces to NOI-2287 (2001) with amendments through NOI-3051 (2014). Complaints are handled by Overland Park Police, and prosecutions proceed under the Municipal Court penalty schedule in Section 7.08.005.
