Spalding County, GA Noise Ordinances: Construction Hours (2026)

Section 11-4002(2) of the Spalding County Noise Abatement and Control chapter lists barred construction hours among the enumerated loud, disturbing, and unnecessary noises. Operating equipment or performing outside construction or repair work on buildings, structures, roads, or projects is prohibited between 11:00 p.m. and 7:00 a.m. in areas zoned commercial or industrial, and the restriction widens to 9:00 p.m. through 7:00 a.m. in every other zoning district in the unincorporated county. This sits alongside a related restriction in section 11-4002(3) barring vehicle repair or testing between 9:00 p.m. and 9:00 a.m. in residential areas in a manner that disturbs residents.

Section 11-4001 backs the specific hour limits with a general ban on any loud noise that disturbs the peace or quiet of a neighborhood or causes discomfort to a reasonable person nearby, and section 11-4005 makes each day the noise continues a separate offense that the magistrate court judge may sentence as circumstances require. The Spalding County Sheriff is the enforcing agency under section 11-4004. Penalties under section 11-4008 follow O.C.G.A. section 15-10-60, the state statute governing magistrate court fines and imprisonment, and a judge may also order community service and require the defendant abate or cure the nuisance.

Exemptions under section 11-4003 cover safety and warning devices, authorized emergency vehicles responding to calls, and work needed to restore property to a safe condition after a public calamity or to protect people or property from imminent danger, none of which excuse routine construction from the hour limits.
