Springdale, AR Noise Ordinances: Construction Hours (2026)

Springdale handles construction noise inside the same Chapter 42 Article III framework as other noise sources, with one important carveout. Section 42-54(b) provides: 'Construction sites will be considered as an industrial zone for purposes of this ordinance.' That gives any active site - residential subdivision, commercial build-out, or industrial project - an 85 dBA daytime / 80 dBA nighttime property-line cap, regardless of the underlying zoning of the parcel. The cap is enforced at the source property line AND at the receiving property line under Section 42-54(a), so even an industrial-classed construction site can be cited if it pushes a neighboring residential receiver above the residential cap at the district boundary (most restrictive limit applies). Section 42-54(d) supplies the safety valve: 'If the chief building inspector shall determine that the public health and safety necessitates the issuance of an emergency permit allowing the erection, demolition, alteration, or repair of any building or the excavation of any building when such work might exceed sound levels found in Table 1, an emergency permit shall be issued. Such emergency permit shall not exceed 14 days duration.' Contractors hauling on city streets remain bound by A.C.A. Section 27-37-601 (muffler requirement on every motor vehicle) and by Federal OSHA Section 1926.52 hearing-conservation rules on the work site itself.
