Full Breakdown
Sec. 62-97 of the Winter Park Code handles construction noise in two subsections. Subsection (a)(9) bars operating a piledriver, steam shovel, pneumatic hammer, derrick, steam or electric hoist, power saw, construction appliance or machine, or construction materials or equipment delivery between 8:00 p.m. and 7:00 a.m. on Monday through Friday, and from 8:00 p.m. on Friday to 8:00 a.m. on Saturday morning, when it creates a noise disturbance across a residential or commercial real property line.
Subsection (a)(11) covers weekends and holidays. The same equipment and deliveries are barred between 6:00 p.m. on Saturday and 7:00 a.m. on the following Monday, and at any time on New Year's Day, Memorial Day, July 4, Labor Day, Thanksgiving Day or Christmas Day, again when the result is a noise disturbance across a residential or commercial real property line. Deliveries count: the trigger words include construction materials or equipment delivery, so a truck drop at the wrong hour is inside the rule.
Subsection (b) lets the city manager or a designee waive applicable portions of the construction noise prohibitions in three situations. The first is when construction conducted within permitted hours would unduly impede, disturb or interfere with transportation networks, vehicular or pedestrian traffic, parking, or other logistical operations ordinarily occurring during permitted hours. The second is emergency work or repairs, including work that must be completed as quickly as possible to avoid injury or damage to persons or property and emergency utility work to restore electricity, water, sewer or other service. The third is work that, if not completed, commenced or finished outside permitted hours, will be damaged or destroyed by expected inclement weather.
Sec. 62-93 also exempts noise alerting persons to an emergency or made in emergency work, city refuse operations and routine maintenance of public service facilities. Hand-held and small power tools are on a separate schedule in (a)(10), 9:00 p.m. to 7:00 a.m. The section's history line runs through Ord. No. 3292-24, adopted 4-4-24.
Violations & Fines
Sec. 62-94 makes a violation of Division 2 punishable as provided in Sec. 1-7. Under Sec. 1-7(c), a conviction carries a fine not exceeding $500.00, imprisonment not exceeding 60 days, or both, and each day a continuing violation lasts is a separate offense. Sec. 62-95 also reaches an owner or lessee who is present and allows a noise disturbance to be created from the property.
