Summary

Manatee County exempts lawn care and domestic power tools from its noise article between 7:00 a.m. and 10:00 p.m. in the unincorporated county. The code never names leaf blowers, so a blower used for yard work falls under that exemption during those hours and under the article's decibel limits and noise-disturbance standard outside them.

These county ordinances apply to unincorporated areas of Manatee County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

The following activities or sources are exempt from the requirements of this article: (1) The emission of sound or noise for the purpose of alerting persons to the existence of an emergency or in the performance of emergency work. (2) Operation of equipment or conduct of activities normal to residential or agricultural communities as set forth herein: Description Hours of Operations a. Lawn care, soil cultivation, domestic power tools, lawn mowers, maintenance of trees, hedges, gardens, saws and tractors, street sweepers, mosquito fogging, tree trimming and limb chipping and other normal community operations 7:00 a.m. to 10:00 p.m. b. Operation of equipment for solid waste and recycling collection in or adjacent to residential uses 6:00 a.m. to 6:00 p.m. c. Operation of equipment for solid waste collection in nonresidential locations 4:00 a.m. to 10:00 p.m.

Full Breakdown

Article II of Chapter 2-21 applies to the unincorporated area of the county under section 2-21-32. Section 2-21-33(2)(a) lists lawn care, soil cultivation, domestic power tools, lawn mowers, maintenance of trees, hedges and gardens, saws, tractors, mosquito fogging, tree trimming and limb chipping among the exempt activities, with a single hours window of 7:00 a.m. to 10:00 p.m. The exemption does not run around the clock. Those prohibitions have two parts. Subsection (1) bans any noise disturbance, defined in section 2-21-31 as sound that can disturb or annoy a reasonable person of ordinary sensibilities or that exceeds the article's limits, judged by factors such as intensity, proximity to residential sleeping facilities, time of day and duration.

Subsection (2) sets measured limits: 60 dBA or 65 dBC from 7:00 a.m. to 11:00 p.m. Sunday through Thursday, extended to midnight on Friday, Saturday and the day before a federally recognized holiday, and 55 dBA or 60 dBC overnight. A residential property next to a commercial use gets 72 dBA or 77 dBC in the daytime window. Readings are taken as a Leq over at least 30 seconds, a continuous sound is reduced by 5 dBA, and a non-repetitive sound under 30 seconds gains 5 dBA between 7:00 a.m. and 11:00 p.m.

No meter reading is needed to prove a noise disturbance. Other exemptions in the same section run on different clocks: residential solid waste and recycling collection from 6:00 a.m. to 6:00 p.m., construction from 7:00 a.m. to 8:00 p.m., and school and athletic-field activity from 7:00 a.m. to 11:00 p.m.

Violations & Fines

The Manatee County Sheriff's Office and County Code Enforcement enforce the article under section 2-21-35. A first violation draws a $100 citation or a notice to appear in county court as a second-degree misdemeanor. A second violation within 365 days draws $250, and a third or later violation within 365 days of the second draws $500. Failing to pay or contest a citation in time counts as an admission and allows judgment for the $500 maximum plus fees and costs.

Frequently Asked Questions

What hours can I run a leaf blower in unincorporated Manatee County?
Section 2-21-33(2)(a) exempts lawn care and domestic power tools from 7:00 a.m. to 10:00 p.m. Inside that window the noise article does not restrict the activity. Outside it, the article's general noise-disturbance ban and decibel limits in section 2-21-34 apply, and the code names no separate leaf blower rule.
Does the county cap leaf blower decibels?
The code has no blower-specific cap. During the exempt 7:00 a.m. to 10:00 p.m. window the measured limits do not apply to lawn care. Outside it, the limit is 60 dBA or 65 dBC until 11:00 p.m., then 55 dBA or 60 dBC overnight, with the evening window extended to midnight on Fridays, Saturdays and the day before a federal holiday.
How long do I have to stop after a complaint?
Under section 2-21-35(2), an officer gives notice and, absent special circumstances, a 15-minute period to correct the violation. The officer can skip that period and cite immediately for a repeat violation within 365 days, a serious threat to public health, safety or welfare, a transient violator, or an irreparable violation.
How do I contest a noise citation?
A citation issued under the article is contested in county court, using the procedure printed on the citation and within its deadline. A notice, as opposed to a citation, can be contested at a hearing before the code enforcement special magistrate. A pending hearing does not let you keep up the activity unless the magistrate rescinds the notice.
