Pasco County's noise ordinance prohibits noise from musical instruments, sound amplifiers, juke boxes, radios, and televisions emanating from a building, structure, or property between 10:00 p.m. and 7:00 a.m. when received within a residential district. The ordinance applies in all unincorporated areas of the county.
Pasco County regulates noise under Chapter 66, Article IV, Division 2 of the Code of Ordinances. Section 66-97 ('Specific noises prohibited') bars sound made by musical instruments, whistles, sound amplifiers, juke boxes, radios, televisions, and similar devices that emanate from a building, structure, or property between the hours of 10:00 p.m. and 7:00 a.m. and are received within a residential district. The ordinance also sets ambient decibel ceilings measured at the closest adjacent residentially-zoned property line: the county's adopted standards limit commercial-zone noise to 60 dBA in the daytime and industrial-zone noise to 66 dBA, dropping to 55 dBA at night and on Sundays, as the Board of County Commissioners summarized in its 2008 ordinance findings. Per Section 2 of the county's noise ordinance, these provisions apply 'in all unincorporated areas of the county,' and within an incorporated municipality only if the municipality expressly adopts the ordinance.
Violations of Section 66-97 are prosecuted as a second-degree misdemeanor pursuant to Fla. Stat. § 125.69(1) and Section 1-6(c) of the County Code, punishable by up to 60 days in jail and/or a fine of up to $500; the county may also pursue civil code-enforcement remedies.
