Pawtucket Code Chapter 286 (adopted 1972, Ord. No. 1369) prohibits noise exceeding the ambient base level by more than 5 dBA at the property line, or sound plainly audible at 50 feet. Stereos and music devices are banned between 11 PM and 7 AM in residential zones.
Under Chapter 286, noise exceeding the ambient base level by more than 5 dB(A) at the property line is prima facie evidence of violation. Alternatively, sound plainly audible at 50 feet from a building or vehicle constitutes a violation. Sec. 286-6 prohibits use of stereos, radios, musical instruments, or other noise-making devices between 11 PM and 7 AM in residential and commercial-local zones that disturb the peace and comfort of neighboring residents. Sound-amplifying equipment requires registration and may only operate between 10 AM and specified evening hours. Commercial sound equipment costs $10/day; noncommercial use is free. Factors for determining violation include noise level, intensity, unusual nature, proximity to sleeping facilities, and background noise level.
First offense: $100 fine. Second offense: $200. Third and subsequent: $300. Any person including police may file a complaint.
