Full Breakdown
Chapter 10.34 of the Issaquah Municipal Code runs two tracks. On private property, 10.34.030 declares the storage or retention of a junk vehicle or its parts a civil violation and public nuisance, and makes it unlawful for any individual, firm, entity or corporation to allow, cause or place a junk vehicle on any premises. The police code enforcement officer enforces it under Chapter 8.45 IMC. Under 10.34.020, a junk vehicle is one certified under RCW 46.55.230 as meeting at least three of four tests: three years old or older; extensively damaged, such as a broken window or windshield or missing wheels, tires, motor or transmission; apparently inoperable; and a fair market value equal only to the scrap in it.
The notice of violation goes to the landowner and the last registered owner and states an abatement deadline, the right to a hearing before the Hearing Examiner under IMC 8.45.110, and the $250.00 per violation per day penalty. If a hearing is requested, notice of the time, location and date is mailed by certified mail with a five-day return receipt requested. A landowner can appear or send a written statement denying responsibility; if the vehicle was placed without consent and the owner has not acquiesced, the City shall not assess removal or administration costs against the property. The section does not apply to a vehicle completely enclosed in a building and not visible, or to one kept in connection with a licensed dismantler or licensed vehicle dealer and fenced according to RCW 46.80.130. After notice and any hearing, the vehicle is removed at a police officer's request and disposed of to a licensed motor vehicle wrecker or hulk hauler, with notice to the Washington State Patrol and the Department of Licensing.
On public streets and lots, 10.28.015 treats a vehicle parked or standing more than 24 hours as a possible abandoned vehicle subject to impound, and 10.34.040(B) requires a notification sticker displayed at least 24 hours before most impounds.
Violations & Fines
The penalty stated in the notice is $250.00 per violation per day, assessed against the landowner and the vehicle's registered owner, if known, under IMC 8.45.120. Removal costs are assessed against the last registered owner or, unless the owner shows the facts in subsection B, against the property owner. If no hearing is requested within 10 days, the vehicle will be impounded or removed and disposed of.
