Full Breakdown

Article II of Chapter 325, adopted March 20, 1979 by Local Law No. 2-1979, is a short two-section article distinct from the County's general parking-lot rules in Article I and the winter parking-lot restrictions in Article III. Section 325-9 draws its authority directly from § 1650(d) of the New York Vehicle and Traffic Law and prohibits parking or abandoning a vehicle on County highways of Saratoga County in four situations: during a snowstorm, flood, fire or other public emergency; when the vehicle is left unattended so that it obstructs traffic; or anywhere that stopping, standing or parking is already prohibited.

The prohibition is written to reach County highways specifically, not private land, and not town, village or city streets, which are governed by each municipality's own code or by the general Vehicle and Traffic Law. Section 325-10 supplies the enforcement mechanism: any vehicle parked or abandoned in violation of Article II may be removed and transported to a suitable place of storage by the Sheriff of Saratoga County, the County Superintendent of Highways, or anyone they duly designate. The removal happens at the risk of the vehicle's owner or operator, who is also responsible for paying the reasonable charges for that removal and storage.

1 of up to $50, Article II sets out no separate monetary penalty of its own; its consequence runs through the cost of towing and storage rather than a fixed fine.

Violations & Fines

A vehicle abandoned or parked in violation of § 325-9 may be towed and impounded at the owner's expense by the Sheriff, the County Superintendent of Highways, or their designee under § 325-10. The owner or operator bears the removal and storage cost and must settle that bill before reclaiming the vehicle. Article II itself sets no separate fine; because § 325-9 is adopted under Vehicle and Traffic Law § 1650(d) authority, an abandonment that also breaches State traffic law can carry additional consequences under that statute.

Frequently Asked Questions

Does Saratoga County's abandoned vehicle law cover cars left on private property?
No. Section 325-9 only reaches vehicles parked or abandoned on County highways during emergencies or where they obstruct traffic or violate a no-stopping rule. A vehicle abandoned on private land or on a town, village or city street falls under that municipality's own code or general State law, not this County provision.
Who can tow an abandoned vehicle under Saratoga County Code?
Section 325-10 authorizes the Sheriff of Saratoga County, the County Superintendent of Highways, or anyone they duly designate to remove and transport a vehicle parked or abandoned in violation of Article II to a suitable place of storage.
Who pays if Saratoga County tows my abandoned vehicle?
The owner or operator does. Section 325-10 places the removal at the risk of the vehicle's owner or operator, who is also responsible for the reasonable charges of removal and storage before the vehicle can be reclaimed.
Is there a fine for abandoning a vehicle on a Saratoga County highway?
Article II does not set its own fine schedule the way the County's parking-lot rules do under § 325-8.1. The consequence is towing and storage cost under § 325-10, and because § 325-9 is adopted under Vehicle and Traffic Law § 1650(d), a related State traffic violation can carry its own separate penalty.
