Full Breakdown
Section 169-15 prohibits depositing or leaving any abandoned or unlicensed automobile, truck or other automotive equipment, or any part thereof, or any other junk, in open fields or upon any public or private property. The one exception is a junkyard licensed under Chapter 169, and then only when the placing is done with the direct permission of the owner of that licensed junkyard. The section states that the Monroe Township Police Department enforces it.
Section 169-16 reaches vehicles kept on a lot. It is unlawful to store, keep or place two or more unregistered motor vehicles, or two or more automobiles which, in the opinion of the Director of Code Enforcement or his designee, are unfit for reconditioning for use for highway transportation, without first obtaining a junkyard license. Used parts of motor vehicles, or material that has been part of a motor vehicle, count too when the sum of the parts or materials is, in the opinion of the Director of Code Enforcement or his designee, equal in bulk to two or more motor vehicles. Section 169-2 uses a parallel test for a motor vehicle junkyard, based on the opinion of the Police Department.
Licensed junkyards have their own intake rules. Under § 169-9D, all vehicles towed or delivered to a licensed facility must immediately be placed within the designated junkyard area, and a vehicle towed there after hours to an overnight storage area must be placed within the storage area within 24 hours. Section 169-13 requires all motor vehicles to be kept within an enclosed area and bars storing them on any sidewalk, street or part of one.
The junkyard license route is narrow. Section 169-19 provides that after the 60-day window following the chapter's effective date, no new license issues unless the number outstanding is fewer than five, and the annual fee is $500 under § 74-20.
Violations & Fines
Under § 169-21, a violation carries a penalty not to exceed $1,000, imprisonment in the Gloucester County Jail for not more than 90 days, or both. The violation must be remedied within 10 days of the penalty, and each additional 10 days it is permitted to exist is a separate offense. The penalty does not prevent the enforced removal of prohibited conditions.
