New Jersey's 2021 Electric Vehicle Charging law (P.L.2021 c.171) and N.J.A.C. 5:23-7 require EV-ready spaces in new development. Bergen County sites and most municipalities reserve EV stalls for active charging only.
Electric vehicle parking and charging in Bergen County is governed primarily by New Jersey state law. P.L.2021 c.171 requires that a percentage of parking spaces in new multifamily, commercial, and public lots be Electric Vehicle Service Equipment installed (EVSE) or EV-capable. NJDCA model ordinance language, adopted by reference in many Bergen County municipalities, designates EVSE-only parking and prohibits non-EV vehicles ('ICE-ing') from occupying charging stalls. At Bergen County facilities and parks, EV stalls are reserved for vehicles actively charging, with violators subject to towing.
ICE-ing or non-charging EVs occupying EV stalls may receive municipal summonses and be towed; fines often $50 to $250 depending on the local ordinance.
