Except as otherwise permitted, in all office-institutional, commercial, interchange activity center, or mixed use zoning districts, it shall be unlawful for any person to permit or cause any commercial vehicle to be parked, kept, or stored in any office-institutional, commercial, interchange activity center, or mixed use zoning district unless: (1)The vehicle is engaged in loading or unloading activity where the driver is present and in charge thereof... Except at otherwise permitted, said vehicles shall not be parked, kept, or stored overnight... Except at otherwise permitted, the use of parking spaces, parking lots, loading zones, or loading docks by operators of commercial vehicles for sleeping or parking overnight is strictly prohibited.

Sec. 3-16-57(a) makes it unlawful to park, keep or store a commercial vehicle in an office-institutional, commercial, interchange activity center, or mixed use zoning district unless it is actively loading or unloading with the driver present, owned or used by a permitted and licensed business on the property, being used in connection with an on-site business's operations, or belongs to a customer of an on-site business parked in a clearly marked and posted commercial vehicle space; even then such vehicles cannot be parked, kept or stored overnight.
Subsection (a)(5) requires that where a commercial vehicle parks under these exceptions, it must use only areas designated and posted as loading zones or loading docks. Subsection (b) separately and strictly prohibits using parking spaces, lots, loading zones or loading docks for sleeping or overnight parking by commercial vehicle operators. Subsection (c) exempts permitted and licensed vehicle rental, leasing or sales facilities conducting their normal business, and subsection (d) bars any licensed business that provides designated commercial parking from acting as a routing agent for those vehicles.
Subsection (e) allows commercial vehicles in hotel or motel lots only for registered overnight guests parked in a marked commercial space, and likewise bars the hotel or motel from acting as a routing agent.
Violations & Fines
Sec. 3-16-59 sets the penalty at a fine of up to $1,000.00, imprisonment of up to 60 days, or both, for any violation of this article, with each day of a continuing violation treated as a separate offense. A violating condition may also be abated by the county as a public nuisance, with the county recovering its enforcement costs, attorney's fees and expert witness fees from the violator.
