Summary

Hinds County requires every commercial or industrial use in the unincorporated county to provide dedicated off-street loading space, separate from customer parking, sized and scaled to the size of the building or land area in use.

City-specific rules exist: Jackson has its own loading zones rules that differ from Hinds County's county-level regulations. If you live in Jackson, check the city-specific page instead.

Adequate off-street space for the loading and unloading of vehicles and for vehicles temporarily stopped ("standing") while waiting to be loaded, unloaded or serviced, shall be provided and maintained for all commercial and industrial uses and any other use involving the receipt or distribution by vehicles of materials, merchandise or other matter on a regular basis... Unless otherwise specified in this Ordinance, loading, unloading or standing space shall be provided in accordance with the following: One loading space measuring at least 12 feet by 35 feet with a minimum height clearance of 14 feet for the first 3,000 square feet of effectively used land area (i.e., excluding setback areas, landscaped areas and parking lots) utilized for the above purposes; PLUS one additional loading space with the same space requirements as above for each 10,000 square feet of effectively used land area above the first 3,000 square feet.

Full Breakdown

Section 2103 of the Hinds County Zoning Ordinance requires off-street loading and standing space for every commercial and industrial use, and for any other use that regularly receives or distributes materials or merchandise by vehicle. That space cannot double as the parking already required for the site: the ordinance says it must be designated so it is not construed as the generally required parking space on the same premises, unless the Planning Commission recommends and the Board of Supervisors authorizes in writing an alternative location.

The baseline standard is one loading space measuring at least 12 feet by 35 feet with 14 feet of vertical clearance for the first 3,000 square feet of effectively used land area (excluding setbacks, landscaped areas and parking lots), plus one additional space of the same dimensions for every 10,000 square feet above that first 3,000. The ordinance itself works two examples: a 3,000-square-foot building or storage yard needs one loading space, while a 23,000-square-foot building or lot needs three. Section 2104 layers on design standards, requiring off-street facilities (loading included) to follow the Institute of Transportation Engineers' Traffic Engineering Handbook or standards set by the Planning Commission or Board of Supervisors.

Because loading space is tied to a building or use permit under Section 401, a site plan reviewed under Section 2408 that omits required loading space can be sent back before a permit issues.

Violations & Fines

Violating Section 2103's loading-space standard is enforced the same way as any other zoning violation, under Section 2413. It is a misdemeanor punishable by a fine of not more than $100.00, and each day a violation is allowed to continue after notice can count as a separate offense. The Director of Permit and Zoning can also go to court to compel compliance, restrain the unlawful use, or block occupancy of a building or lot that lacks its required loading space.

Frequently Asked Questions

How many loading spaces does a Hinds County business need?
One space for the first 3,000 square feet of effectively used land area (excluding setbacks, landscaping and parking), plus one more for every additional 10,000 square feet. A 23,000-square-foot building needs three spaces under Section 2103's own worked example.
Can a Hinds County business count its parking lot as loading space too?
No. Section 2103 requires loading space to be separate from the parking otherwise required for the use, unless the Planning Commission recommends and the Board of Supervisors approves an alternative location in writing.
What happens if a Hinds County property does not have required loading space?
It is a misdemeanor under Section 2413, punishable by a fine of up to $100.00, with continuing violations able to count as a separate offense each day. The Director of Permit and Zoning may also seek a court order to stop the noncompliant use.
