Santa Barbara County Code § 12A-24 makes it unlawful to stop, stand, or park any vehicle between 11:00 p.m. and 5:00 a.m. in any off-street parking area owned or operated by the County, except in designated Safe Parking Program lots or for electric vehicle charging.
Adopted by Ordinance 5163 (Oct. 4, 2022) under authority of California Vehicle Code § 22519, Chapter 12A Article V of the Santa Barbara County Code regulates all off-street parking facilities owned or operated by the County. Section 12A-24 prohibits overnight parking between 11 p.m. and 5 a.m. unless specifically authorized by the Director of General Services or by another county ordinance or resolution. Exceptions exist: (1) Safe Parking Program lots designated for overnight use consistent with Martin v. City of Boise (9th Cir. 2019) 920 F.3d 584, and (2) overnight parking for electric vehicle charging at county EV stations. Vehicles in violation may be towed after 72 hours' notice (§ 12A-26(c)) under California Vehicle Code § 22651(n).
Overnight parking violations are subject to administrative penalty under Chapter 24A or civil parking penalty under California Vehicle Code § 40200 et seq. The Director of General Services, the Sheriff, and county security staff may issue citations and may have vehicles towed if not removed within 72 hours of notice.
