These county ordinances apply to unincorporated areas of Okaloosa County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

All county parks, including river and beach access points, shall be closed between one hour after sunset and one hour before sunrise. No person, firm, corporation, joint venture, partnership, or other legal entity shall enter, occupy, trespass or use any county park in Okaloosa County during the time that the same is closed to the public pursuant to the signs posted in conspicuous places at the entrance to the same. Overnight parking is prohibited. Exceptions to this section include: Loading and unloading of watercraft at parks specifically designated for afterhours boat ramp use; and utilization of parks with lights for sponsored events until 9:30 p.m., at which time the lights must be extinguished. No overnight parking allowed at James Lee Park from 11:00 p.m. Central Time until one hour before sunrise. Violators will be towed at the vehicle's owner expense. No umbrellas or tents shall be on the beach between the hours of 12:00 a.m. and 7:30 a.m. This is to allow for proper cleaning and inspection of the beach. Full Breakdown

Sec. 16-52 of the county code shuts every county park, including river landings and beach access points, to the public between one hour after sunset and one hour before sunrise, and forbids anyone from entering, occupying, trespassing on, or using a park during those closed hours, and separately bans overnight parking outright. , after which the lights must go dark. m. Central Time until an hour before sunrise, and any vehicle left in violation is towed at the owner's expense. so crews can clean and inspect the beach before daylight.

The Pier and Newman C. Brackin Park are exempted from Sec. 16-52 entirely. Enforcement runs through Sec. 00 for a third or subsequent violation, separate from the county's general beach and park penalty schedule. Anyone cited can pay the fine by the date on the citation or contest it in county court, though requesting a hearing waives the right to the reduced civil-penalty amount.

Violations & Fines

A citation for violating Sec. 16-52's overnight parking or park-hours rules carries a $50.00 fine for a first offense, $150.00 for a second, and $300.00 for a third or subsequent offense, set out in Sec. 16-51(c). Vehicles left overnight in a closed park, or past the 11:00 p.m. James Lee Park cutoff, are towed at the owner's expense. Citations are payable to the clerk of court by the stated date, or the recipient may appear in county court, though a hearing request forfeits the reduced civil-penalty rate.

Frequently Asked Questions

Can I leave my car overnight at an Okaloosa County beach access point?
No. Sec. 16-52 closes every county park, river access, and beach access point between one hour after sunset and one hour before sunrise and bans overnight parking during that window. A vehicle left in a closed park overnight is towed at the owner's expense, and the driver also faces a civil citation under Sec. 16-51(c) starting at $50.00 for a first offense.
What's the parking cutoff at James Lee Park specifically?
James Lee Park has its own, earlier curfew than other county parks: no parking is allowed there from 11:00 p.m. Central Time until one hour before sunrise. Vehicles found parked during that window are towed at the owner's expense under Sec. 16-52, on top of any civil citation issued under the county's park-hours penalty schedule.
Are there any exceptions to the overnight parking ban?
Yes, two. Boat ramps specifically designated for afterhours use allow loading and unloading watercraft outside normal park hours, and parks hosting a sponsored event may keep lights on until 9:30 p.m. before going dark. The Pier and Newman C. Brackin Park are exempted from Sec. 16-52 altogether, so its overnight parking ban does not apply there.
What's the fine for violating the overnight parking rule?
Sec. 16-51(c) sets a $50.00 civil penalty for a first hours-of-use violation, $150.00 for a second, and $300.00 for a third or subsequent violation. Requesting a court hearing instead of paying the fine waives the right to that reduced civil-penalty amount, and towing costs for any vehicle removed from a closed park are billed separately to the owner.
