Full Breakdown
Elko County Code § 4-8-16 is a two-part rule in Chapter 8 of the zoning title, Title 4, and it applies in unincorporated Elko County, Nevada. Subsection (A) says no person shall place or install a home security camera with the intent to capture images or video record areas of another person's home and/or real property wherein there is a reasonable expectation of privacy. The sentence turns on two elements: the installer's intent, and a reasonable expectation of privacy in the area being recorded.
Subsection (B) defines "home security camera" as any video recording device or any other device that captures images used for security and/or surveillance on real property. The definition names no product type and sets no resolution, storage or sharing standard. The printed history note lists Ord. 2021-03, 10-20-2022.
The section contains a prohibition and a definition. It prints no registration step, fee, signage or notice requirement for a camera owner.
Enforcement runs through the zoning title. Under § 4-9-13, the code enforcement officer for the Division of Planning and Zoning investigates alleged violations, notifies the owner or person in possession or control of the property, and requests that it be corrected. The officer can give an oral or written warning, which can precede or replace a written citation, and can prepare, sign and serve written citations. Zoning enforcement staff can enter private property for enforcement, but entry into any building requires the consent of the owner or person managing it, or an application to the Justice Court showing good cause. A person alleging error in an order or determination by a county employee can appeal in writing to the Planning Commission within ten days under § 4-9-3, and a Planning Commission decision becomes final unless a notice of appeal to the County Board of Commissioners is filed within ten days. The cities of Elko, Carlin, Wells and West Wendover are not covered by this section.
Violations & Fines
Violating the zoning title, including § 4-8-16, is a misdemeanor under § 4-9-14(B) punishable by a fine of not more than $1,000, up to six months in jail, or both. Each day of violation is a separate offense, and conviction does not relieve the person of the duty to correct the condition. The use is also declared a public nuisance.
