Concord Municipal Code Chapter 8.10 declares inoperable, wrecked, dismantled, or abandoned vehicles on public or private property a public nuisance subject to abatement under California Vehicle Code Β§22660. Notice and a 10-day opportunity to request a hearing are required before removal. Vehicles must be screened from public view or removed.
Pursuant to California Vehicle Code Β§22660, Concord has adopted Municipal Code Chapter 8.10 authorizing the abatement and removal of abandoned, wrecked, dismantled, or inoperative vehicles from public and private property as public nuisances. A vehicle is generally considered "inoperative" if it lacks current registration, cannot be moved under its own power, is missing essential parts (engine, wheels, transmission), or has been stationary more than a defined period. Enforcement begins with a Notice of Intent to Abate, posted on the vehicle and mailed to the registered owner and property owner, providing 10 days to request a hearing before a city hearing officer. If no hearing is requested or the officer finds a nuisance, Concord contracts with a tow operator to remove and dispose of the vehicle. Costs are recovered through a special assessment/lien on the property under Government Code Β§38773. On private residential property, junk vehicles may be exempted from abatement if stored entirely within a legal enclosed garage or behind a fence/screen that completely blocks public view from any public right-of-way. Vehicles on public streets are additionally subject to Vehicle Code Β§22651(k) (72-hour rule) and may be towed faster. Concord Police and Code Enforcement handle vehicle abatement jointly.
