Denton County has limited authority to address property blight in unincorporated areas. The county can order abatement and, if the owner fails to comply after notice, perform the cleanup and place a lien on the property for costs. Texas Transportation Code Section 683.071 also authorizes counties to address junked vehicles visible from public rights-of-way. The county cannot regulate general aesthetics, peeling paint, structural disrepair, or landscaping appearance — these powers are limited to municipalities under Texas law. HOA deed restrictions in master-planned communities provide the primary blight enforcement mechanism in many unincorporated Denton County subdivisions.
Failure to abate a nuisance after proper notice under Chapter 343 can result in the county performing the cleanup and placing a lien on the property for costs incurred. Junked vehicle violations under Transportation Code 683 can result in vehicle removal after 10-day notice.
