Eagan regulates blighted and deteriorating property primarily through the International Property Maintenance Code (IPMC), 2021 edition, which the City adopted by reference in City Code Section 10.53 (the code-adopted IPMC deletes Section 308, Rubbish and Garbage, which Eagan regulates separately). The City's published property maintenance guidance summarizes the resulting standards: there must be no accumulation of dirt or filth that could create a health hazard, and the exterior of a property must be maintained in a clean, safe and sanitary condition. Exterior surfaces, including doors, frames, windows, trim and porches, must be free of holes, deterioration or rotting, and finishes may not be deteriorated (peeling, cracked or chipped paint) on more than 20 percent of a wall, door or similar surface. Roof structures, drains, gutters, downspouts, fascia and trim must be in good repair and securely attached, and retaining walls must be structurally sound. Sidewalks, walkways, stairs, driveways and parking spaces must be sound and free from hazardous conditions, and handrails and guardrails must be firmly fastened. Enforcement is complaint-driven: staff inspect from the public right-of-way (or with permission), issue a notification letter citing City Code, and escalate to a citation or referral to the City Attorney only as a last resort.
Violations are handled through Eagan's complaint-driven code enforcement process. Easily remedied conditions are typically given 3 to 10 days to comply; more complex conditions receive longer timeframes. Property owners receive a notification letter citing City Code, then a possible second letter, and finally a citation or referral to the City Attorney if non-compliance continues.
