Brevard County Code Β§22-26 requires vacant lot owners to maintain grass/weeds below 12 inches, remove trash, and prevent nuisance conditions. County may mow and bill owner. Fire hazard enforcement escalated during dry season.
Brevard County Code Β§22-26 (Overgrown Vegetation) requires vacant lot owners to maintain grass, weeds, and non-ornamental vegetation at or below 12 inches in height. Applies to improved and unimproved residential lots within platted subdivisions. Agricultural-zoned parcels and undeveloped acreage outside platted subdivisions exempt. Trash, debris, abandoned vehicles, and tires must be removed. Notice of Violation issued by Code Enforcement (321-633-2086) with 10-day compliance period. Non-compliance triggers county abatement (mowing contractor) at owner expense, typically $150 to $500 per occurrence depending on lot size. Costs become a lien against the property under FL Β§162.09. During Florida dry season (March-June), enforcement escalates due to fire hazard. Vacant lots adjacent to conservation areas or the Space Coast Wildlife Management Area face additional scrutiny. Vacant structure registration separate under Β§22-82.
10-day notice to correct. County abatement: $150 to $500+ per mowing. Lien placed on property via Special Magistrate. Repeat violations: $500 per day. Fire hazard during dry season: expedited enforcement.
