Lakeland, FL Public Conduct: Aggressive Panhandling (2026)

Lakeland Code Chapter 78, Article III defines "aggressive manner" soliciting to include approaching, following, or speaking to someone in a way likely to make a reasonable person fear bodily harm or property loss; continuing to ask after a negative answer; touching the person solicited without consent; blocking or interfering with safe pedestrian or vehicle passage; using violent or threatening gestures; following the person with intent to ask for money; and asking anyone standing in a line for entry to a building or event (§ 78-61(1)).

Section 78-62 bans soliciting in an aggressive manner anywhere in a public place, and separately bans solicitation on private property without the owner's permission. It creates fixed buffer zones: no soliciting within 20 feet of a public restroom entrance on public property, within 20 feet of a financial institution, check-cashing business or ATM (measured from the facility entrance if the ATM sits inside one), within 20 feet of a pay telephone or booth, or within six feet of any building entrance without the owner's consent.

It is separately unlawful to solicit a motor vehicle operator or occupant on a street for vehicle-related services (except emergency repairs the driver requested), to solicit money in exchange for reserving or directing a public parking space, to solicit while under the influence of alcohol or drugs, to solicit by falsely claiming a specific unmet need, or to solicit inside a public transit vehicle or at a bus or train stop.
