Elkhart County, IN Public Conduct: Aggressive Panhandling (2026)

Section 70.50 of the Elkhart County Code of Ordinances, adopted by Ordinance 2012-425 on October 15, 2012, prohibits solicitation for funds, donations or other contributions within the travel lanes of any road, street or highway in the unincorporated area of the county. The ban covers any individual, group, organization, fund, community chest or fraternity, and it applies whether or not the solicitor offers a tangible item in exchange. The rule targets the physical act of stepping into traffic lanes to collect money from drivers, not panhandling on sidewalks or private property, which this chapter does not reach.

Enforcement runs through § 70.99(C): the County Sheriff's Department or another law enforcement agency issues citations under I.C. 34-28-5 et seq. and I.C. 9-30-3-6, and prosecutes them the same way. Each violation carries a civil penalty of up to $500, and every day a person continues soliciting in the travel lanes counts as a separate violation, so a multi-day roadside fundraising drive can compound quickly. Because the prohibition sits inside Chapter 70's traffic and right-of-way regulations rather than the criminal code, a citation lands as a civil infraction rather than a misdemeanor.

Groups that want to raise money roadside in unincorporated Elkhart County, including fire departments, school boosters and civic clubs running a traditional boot drive, need to keep collectors off the traveled portion of the roadway, working the shoulder, median or an adjacent parking lot instead. The ordinance creates no permit process or waiver to authorize in-lane solicitation.
