Haverhill, MA Public Conduct: Outdoor Smoking Restrictions (2026)

Article IV of Chapter 193, Conservation Areas, lists seven properties the City maintains for public recreation, including Winnekenni Park, Meadow Brook, Tattersall Farm, John's Woods, Lake Saltonstall, Lake Pentucket and the Crystal Lake parcels. Section 193-22, Alcohol, tobacco, and firearms, specifically bars smoking tobacco products or similar devices at Tattersall Farm, alongside separate bans on alcohol and firearms across the conservation areas generally. Section 193-25 sets the penalty for any violation of that article at up to $300 per day, on an escalating schedule of $50 for a first offense, $100 for a second, and $300 for a third or subsequent offense, with each day of a continuing violation counted as a new offense.

Those fines can be issued by state or local police, local animal control officers, state environmental police officers, or the Haverhill Conservation Officer, with restitution for any damage added on top. A second, separate smoking ban applies along the Bradford Rail Trail: § 193-28, adopted in 2011, bars smoking of tobacco products or similar devices on the corridor or pathway without written permission from the Chief of Police, alongside bans on motorized vehicles, hunting, alcohol, unleashed dogs and camping. Section 193-29 sets Rail Trail fines at $50 to $100 for a first offense, $100 to $200 for a second, and $300 for a third or subsequent offense.
