Following Florida's 2022 amendment to the Florida Clean Indoor Air Act (HB 105), which authorized cities and counties to ban smoking in public parks and beaches, the City of Miami enacted a Smoke-Free Public Areas ordinance in Code Sec. 38 (Parks). Smoking and vaping (electronic smoking devices) are prohibited in all Miami parks, recreation areas, playgrounds, and city beaches; unfiltered cigars are also covered. The ordinance does not extend to public sidewalks adjacent to parks. State preemption still bars Miami from regulating private indoor and outdoor smoking beyond statewide minimums. Miami-Dade County beaches outside city limits enforce a parallel rule.
Smoking in a Miami park or beach is a civil infraction starting at 50 dollars for a first offense, escalating to 250 dollars for repeats. Park rangers and police issue citations. Persistent violators may face trespass warnings.
