Port St. Lucie, FL Public Conduct: Outdoor Smoking Restrictions (2026)

Sec. 26, adopted city-wide as part of the September 2022 overhaul of Chapter 96 (Ord. No. 22-82, Sec. 2), states in full that smoking is only allowed in posted designated smoking areas in city parks and on city properties. The rule reaches beyond park land to any city-owned property, but it does not create an outright ban: smokers can still light up if they are standing in an area the city has actually posted and designated for that purpose. Because the ordinance ties compliance to posted signage rather than a fixed list of locations, the enforceable boundary at any given site is whatever the city has physically marked there.

Enforcement of Sec. 26 runs through the same general Chapter 96 mechanism as every other park-conduct rule: under Sec. 03, the director, any parks and recreation employee, or a law enforcement officer may eject a person smoking outside a posted area and, with police assistance, issue a Trespass After Warning (TAW) barring the person from that park or facility for up to a year. The director's general rulemaking authority under Sec. 02 also lets the department post additional smoking-area signage or adjust where the designated spots sit as facilities change.

Because Sec. 26 sits in Article V, Behavior and Conduct, alongside the alcohol and fireworks rules, city staff treat a smoking violation as a behavior-and-conduct offense subject to the chapter's standard penalty and ejection tools rather than a separate citation scheme.
