Washington County, UT Public Conduct: Outdoor Smoking Restrictions (2026)

County Code chapter 4-6 was adopted under the authority of Utah Code Annotated section 17-53-223 to protect public health and the environment and to keep the county's public spaces family friendly (§ 4-6-1, § 4-6-2). Section 4-6-4 prohibits smoking, defined in § 4-6-3 to include carrying a lit cigarette, cigar or pipe as well as using electronic smoking (vaping) equipment, on all Washington County property, expressly naming the County Legacy Park, the former county fairgrounds and its parking areas and buildings. The ban carries three narrow carve-outs: the county may designate a specific smoking area that can move depending on county needs; smoking is permitted inside a private vehicle with the windows rolled up; and overnight campers in private trailers at the Legacy Park may smoke inside their trailer.

Section 4-6-4(C) requires the county to post 'No Smoking' signs, or the international no-smoking symbol, conspicuously at the Legacy Park and in any other area where the ban needs reinforcement. The chapter was originally adopted by Ordinance 2017-1089-O on May 2, 2017 and amended by Ordinance 2019-1151-O on December 17, 2019. Because the prohibition covers 'all Washington County property,' it reaches county parks, administrative buildings, parking lots and outdoor patios attached to county facilities, not just the fairgrounds; the Legacy Park references simply single out the venue where the county expects the heaviest foot traffic and event use.
