Summary
Westland prohibits consuming or smoking marihuana in any public place, including parks and sidewalks, and bars smoking it anywhere the property owner, occupier or manager has posted a prohibition.
(b)No person shall do any of the following:(1)Operate, navigate, or be in physical control of any motor vehicle, aircraft, snowmobile, off-road recreational vehicle, or motorboat while under the influence of marihuana. Violation of this subsection is subject to penalty as provided for in section 98-37—98-370 of the Westland City Code;(2)Transfer marihuana or marihuana accessories to a person under the age of 21;(3)Separate plant resin by butane extraction or another method that utilizes a substance with a flashpoint below 100 degrees Fahrenheit in any public place, motor vehicle, or within the curtilage of any residential structure;(4)Consume marihuana in a public place or smoke marihuana where prohibited by the person who owns, occupies, or manages the property;(5)Cultivate marihuana plants if the plants are visible from a public place without the use of binoculars, aircraft, or other optical aids or outside of an enclosed area equipped with locks or other functioning security devices that restrict access to the area;(6)Consume marihuana while operating, navigating, or being in physical control of any motor vehicle, aircraft, snowmobile, off-road recreation vehicle, or motorboat, or smoking marihuana within the passenger area of a vehicle upon a public way;

Sec. 62-337(b)(4), adopted under Ord. No. 101-G-9-2 on August 19, 2019, bans consuming marihuana in a public place and bans smoking marihuana wherever the person who owns, occupies or manages the property has prohibited it. The same subsection separately bars smoking marihuana inside a vehicle's passenger compartment on a public way and prohibits marihuana use on school grounds, school buses, and correctional-facility grounds. The rule implements Michigan's Regulation and Taxation of Marihuana Act, MCL 333.27951 et seq., which lets cities regulate public consumption locally; it does not address tobacco.
