Full Breakdown
The Common Council of the City of Columbus, Indiana authorized a designated outdoor refreshment area in § 5.30.020 and named it the Downtown Columbus Social District. Section 5.30.110 sets the operating rules under Indiana Code 7.1-3-31, and its terms are specific.
A person can consume an alcoholic beverage purchased from a designated permittee or vendor anywhere within the refreshment area boundaries. A drink bought outside the area cannot be consumed inside it. Any retailer permittee or business in the area can refuse to let people enter its premises carrying alcohol, and § 5.30.090 confirms a business can also choose to allow open containers inside.
Designated permittees and vendors can let a person leave with not more than two open containers at a time. A beer or flavored malt beverage cannot exceed sixteen ounces. Wine, cider or hard seltzer cannot exceed twelve ounces. A mixed drink cannot exceed ten ounces and cannot contain more than two ounces of liquor. Drinks must be in a designated Downtown Columbus Social District cup or an approved container with a district decal, and glass is allowed only in a designated permittee's outdoor dining area and cannot be taken into the district.
Section 5.30.060 makes the district operational seven days a week, three hundred sixty-five days a year, between 10:00 a.m. and 12:00 a.m. The boundaries appear on a map in § 5.30.040, and signage in § 5.30.050 includes a logo at the boundaries, a window cling near participating businesses, and a sign at each permittee exit. Section 5.30.100 gives the city full control of sidewalks and common areas inside the district: only the board of public works and safety and the Columbus common council can prohibit or limit open containers there.
A business or vendor cannot operate as a designated permittee or vendor unless registered with the city under § 5.30.030(C). Listed permittees in § 5.30.070 include restaurants and bars on Washington Street, 4th Street and nearby blocks, and other licensed premises in the district apply to the city for approval by board resolution.
Violations & Fines
Section 5.30.130 fines any business, entity, applicant, vendor or permittee that violates Chapter 5.30 up to two thousand five hundred dollars for the first violation and up to seven thousand five hundred dollars for the second or subsequent violation. Each day a violation exists is a separate offense. Operating as a designated permittee or vendor without registering with the city is unlawful.
