Detroit prohibits open alcohol containers on streets, sidewalks, and parks except within designated Social Districts authorized under MCL 436.1551. Outside those zones, public drinking is a misdemeanor.
Detroit Code Chapter 5 enforces Michigan Liquor Control Code, MCL 436.1101 et seq., banning consumption of alcoholic beverages on public streets, sidewalks, parks, and parking lots. The exception is Michigan's 2020 Social District law, MCL 436.1551, which Detroit has used to designate commons areas in neighborhoods like Rivertown and along select downtown corridors where commons-area cups from licensed establishments may be carried. Outside Social Districts, possession of an open container in a vehicle violates MCL 257.624a, and drinking on public ways violates city order. DPD enforcement focuses on unruly behavior more than incidental violations.
Open container violations are misdemeanors with fines up to $500 and possible 90 days jail. Vehicle open-container offenses add points and possible driver license sanctions under Michigan Secretary of State rules.
