Fountain Valley, CA Public Conduct: Public Alcohol Use (2026)

In the City of Fountain Valley, § 8.36.010 says no person shall drink any alcoholic beverage in any public place in the city. The rule is about drinking, and the text does not use the phrase open container or address possession. Section 8.36.020 defines public place broadly: public streets, alleys, sidewalks, parkways, parks, playgrounds, parking lots open to the public, school grounds and public recreation areas within the city. It also pulls in the open areas and common areas of apartments, condominiums and other multifamily dwelling property, including landscaped common areas, recreation areas, private streets, common pool areas, hallways, open garage ports, alleys and other areas not enclosed by a private fence.

One carve-out sits in § 8.36.030: the front yard areas of any single-family residence are excluded, whether enclosed or not. That means a resident drinking in a single-family front yard falls outside the chapter, while the same person drinking beside an apartment complex pool or in its open courtyard falls inside it. The chapter was adopted as Ordinance 1268 in 1997. Enforcement falls to the City of Fountain Valley police, and because the ordinance sits in Title 8, Public Peace, Morals and Safety, it applies citywide to every public place the definition reaches.
