City Code Sec. 34.107 makes it unlawful to possess an open alcoholic beverage container or consume alcohol in a public place within the Central Business Area between 10:00 p.m. and 2:15 a.m. The ban does not reach motor vehicles, buildings not owned or controlled by the city, private residences, or licensed premises inside the CBA. Outside those hours or that footprint, no local open-container ordinance applies. A separate Sec. 58.033 bars public alcohol display or consumption in city parks and along the San Marcos River at any time.
