No person shall give, sell, deliver or consume any alcoholic beverage, including but not limited to beer and wine, on any street nor shall any person have in his or her possession an open container containing such beverage on any street... For purposes of this subsection a container shall be deemed open, regardless of its closed or capped condition if the original sealant of the bottler has once been broken.

Sec. 9-1(a) prohibits giving, selling, delivering, possessing (open or unopened), or consuming alcohol in a public park, playground, rest area, school grounds, recreational area, swimming pool, or skating rink, and any container found in violation, opened or not, is confiscated. Subsection (b) separately bans drinking or holding an open container on any street, defining a container as 'open' if the bottler's original seal has ever been broken, regardless of whether it is capped again. The street ban has two carve-outs: a licensed common victualler with an outdoor-seating permit under Sec.
12-14 who is also licensed by the Somerville Licensing Commission to serve alcohol outdoors, and their patrons; and an organizer licensed to run a festival, fiesta, street fair, or similar event under Sec. 8-14(a) who is permitted to serve alcohol within the event boundary, and that event's patrons. Subsection (c) extends the ban to the common areas of city housing authority projects, defined broadly to include hallways, stairwells, front steps, basements, rooftops, sidewalks, parking areas, roadways, and park areas. Public events on park or recreational land, other than athletic fields, can serve alcohol only with prior written city council consent plus a Licensing Commission permit, and only if no disturbance results (Sec. 9-1(a)(1)).
