Texas City, TX Public Conduct: Public Alcohol Use (2026)

Chapter 119 of the Texas City Code of Ordinances layers three public-drinking rules. The broadest is § 119.08: it is unlawful for any person to consume any alcoholic beverage while on any street, sidewalk or other public way in the city. That rule has no hour limit, so a drink on a sidewalk is an offense at noon as much as at midnight. It targets consumption, and the section does not print a separate open container offense.

Section 119.06 covers any public place and works by clock. It is unlawful to consume alcohol in a public place, or to possess it there for the purpose of consuming it, on Sunday between 2:15 a.m. and 12:00 noon and on all other days between 2:15 a.m. and 7:00 a.m. Chapter 119 adopts the definitions of the Texas Alcoholic Beverage Code, and the ordinance itself lists Tex. Alcoholic Beverage Code § 105.06(c) as a similar provision. Nothing in the excerpted text limits the rule to Texas City's parks or the Texas City Dike, so the wording reaches every public place inside the corporate limits.

Section 119.14 is a venue rule. It is unlawful to bring or carry into any enclosure, field or stadium where athletic events sponsored or participated in by any public school are being held any alcoholic beverage, or to have alcohol in possession while in or on that enclosure, field or stadium.

Separate rules apply to private clubs under § 119.07, with its own hours, and to minors under § 119.13. Event organizers who plan to serve alcohol at a permitted carnival need the state permit and $1,000,000 liquor liability insurance under § 118.005(G). Enforcement runs through the Texas City Police Department and the municipal court.
